1. Acceptance of Terms
1.1 Our terms and conditions are reviewed and revised from time to time, therefore we advise you to view this page on a regular basis. Your use of ShotCrew, its products, and its services constitutes your acceptance of these terms.
1.2 You are in full agreement with and bound by the terms and conditions listed below by ShotCrew. If you do not agree with the below terms and conditions, do not use any of the services or products provided by ShotCrew.
1.3 In this document, when we say ‘we’, ‘us’, ‘our’ or ‘ShotCrew’ we are referring to the company ‘ShotCrew’.
2. Your Product Guidelines
2.1 Companies with products including but not restricted to food, drink, skincare, sporting equipment, and fitness equipment, should be aware that we cannot guarantee that the product will be in its original condition due to the handling of the products during photoshoots.
2.2 We will not accept applications from businesses which do not align with the ethics and values of ShotCrew. This includes but is not restricted to businesses that promote alcohol, drugs, racism, violence, and erotica.
2.3 We reserve the right to decline an application to take on any business as a client without providing reason or justification. We also reserve the right to terminate an existing membership to ShotCrew at any time without providing reason or justification.
2.4 To do our best work in an effective and efficient manner, we require your full co-operation in sharing helpful business information including but not restricted to: customer demographic data, and marketing plans related to the photography.
3. Your Information
3.1 We do not store your payment or credit/debit card information. We use a secured third-party service (Stripe) to process payments. To learn more about Stripe’s handling of your data, please visit https://stripe.com/gb/privacy
3.2 ShotCrew will protect your personal information such as your name and address and will not share with any third party services unless spoken about with you in writing.
3.3 You acknowledge that the information you give to us is accurate and complete.
3.4 You are responsible for keeping your information (such as email addresses and other forms of contact) up to date.
4.1 For any product that you ask us to create content of, you warrant that you have all necessary rights and licenses set forth. You also agree that the product that you are asking us to create content of is not infringing any third party rights, including any privacy rights or intellectual property rights.
4.2 For any photography that ShotCrew creates for your business, you grant ShotCrew a royalty-free license and right to copy and distribute for marketing and portfolio purposes unless otherwise agreed upon with a member of our team in writing.
4.3 You may not request the production of any content that does not align with the ethics and values of ShotCrew. This includes but is not limited to:
- Pornographic content
- Defamatory, illegal or otherwise immoral content
- Promotion of fraudulent schemes
- Content that violates laws
- Content promoting racism, violence, or drug use.
4.4.1 A production period of 14 days is allocated to the planning, shooting, and editing of your photography. This period does not begin until ShotCrew receives both the products you want to have photographed and the submission of your photography questionnaire.
4.4.2 Once ShotCrew has completed production, your photos will be delivered to you via an email including a private link to a password-protected DropBox link. Requests for a re-shoot will only be accepted if it can be proven that the content created was not synonymous with the style that was agreed upon between ShotCrew and yourself. ShotCrew will retain the photography questionnaire that you submit, as well as any recordings of phone conversations between ShotCrew and yourself, to help provide context.
4.5 All the photography created by ShotCrew that is sent to you, including those with your brand’s products can be used for any purposes, as long as they are not defamatory toward ShotCrew in any way. You will own complete rights to any of the photos that we deliver to you, so you can use them in multiple ways, including but not limited to social media, your website, or in a magazine.
5.1 Given the nature of digital products, refunds can not be provided once content has been created unless it violates a law or ShotCrew has breached any legal documentation.
5.2 Refunds in full cannot be provided once content has begun the production process.
5.3 Refunds cannot be provided at all once the photoshoot has been completed.
5.4 There is no obligation to provide a refund in the following scenarios and in situations akin to:
- You changed your mind about the style/theme of your content
- The service was bought for you but you do not require it
- You ask for goodwill
- You were unclear about the services offered by ShotCrew
6. Your Products
6.1 You are responsible for packaging your products in a manner in which they will not become damaged in transit.
6.2 ShotCrew is not liable for the mistakes of any third party courier service that we use.
6.3 If the item is lost or damaged in transit, you are responsible for providing us with a new product(s).
6.4 You are responsible for providing a return shipping label so ShotCrew can return your products. If you have not provided a return shipping label within 30 days of your photos being delivered, ShotCrew reserves the right to keep your products.
